I move to reconsider Ordinance 26-4, the Kelly Tractor CDMP application that was heard at the January 22, 2026 CDMP meeting. I make this motion because the applicant wants to comply with the points the Mayor brought up in her veto message, which she reiterated. The applicant will be proffering additional on-site wetlands preservation as well as additional wetlands preservation within the North Trail Basin.

Motion to reconsider Kelly Tractor application

If we're going to make a collective decision, we all have to have the same information.

Advocating for equal access to information among commissioners

Commissioner Gonzalez is right on point on the information. I've been asking for information from the entity that's going to be building this facility, and supposedly that information has been proffered to staff, but I don't have it yet.

Expressing concern about unequal distribution of information to commissioners

What we want to do here is bring immediate relief to businesses, some who do no cooking, and they were here. Many of them were here. They do no cooking, and as far as the inspections, I trust Mr. Coley, now that we established that he's a truthful Alabama fan, to give us great, great proposals.

Discussion of 11A12 and business relief from fog regulations

Because of timing for it to come back to us and being super clean they just need to send a letter to the staff just had to send a letter to the state requesting 180 day extension so we can hear it just in case even though we're not at the 180 days and knowing the way things work just in case.

Proposing motion for 180-day extension notice to state

It's in the urban expansion area. The only reason I'm bringing that up is because I think if it's in the urban expansion area, I could see staff saying, hey, it's happened before, you're in the UEA, we'll take a look.

Speculating on how staff might have directed applicant

Nobody spends this much money unless somebody tells them, hey, somebody else did it. You're in the urban expansion area.

Arguing applicant must have received guidance

The parcel is in the urban expansion area. There was another application right by this one in this urban expansion area. We were even considering building a water and sewer facility in this exact parcel.

Providing context on parcel location and prior plans

With all due respect to Mr. Coley and the urban expansion area number one includes this. It's within that area. We had another text amendment in that area. So I'm not saying he hasn't been able to find somebody, not at all. It's possible that he's right. Maybe the person's not there anymore.

Offering alternative explanation for lack of identified staff member

One month to give the administration an opportunity to sit down and speak to the applicant and see if some of these concerns can be resolved.

Proposing one-month timeline for reconsideration

The reason why this motion for reconsideration is proffered because I believe there might be an opportunity for the administration to work with this particular applicant and the applicant is fine with it.

Rationale for motion for reconsideration

When it was created it was created to be revisited and instead we're going to do it application by application.

Historical context on UDB's intended purpose

It's used very loosely which is why we've got to revisit it and I've said it over and over to the administration. I've said it to the environmentalist, and I said it to the developers everybody should sit in the room and look at why we haven't moved this line in over 50 years.

Criticizing loose application of UDB and advocating for comprehensive review

This was transmitted to the state and nobody said anything about it at that time and I guess if we were going to talk about text amendments, etc., at the time then we really should have talked about it back then.

Noting state transmission occurred without prior objection

I think there's a Solomonic solution to allow the staff and the administration, in particular the staff, to deal with some of the issues that some of my colleagues brought up so eloquently, including Commissioner Regalado about the wetlands mitigation.

Commissioner Bermudez characterizing the motion to reconsider

The expansion of Northwest 107th Street, Northwest 180th, Northwest 92nd Avenue, Northwest 102nd Avenue which are critical not only to District 12 but to District 13 and to the residents of Hialeah, Miami Lakes, Hialeah Gardens which is basically an eight million dollar bill.

identifying specific road projects needing state funding

When Commissioner Lopez spoke specifically about transportation I think it's important that we urge the Florida legislature to fully fund the Florida job growth grant fund.

advocating for transportation funding

I want to thank Commissioner Lopez for that enlightened presentation of what's going on and and I thank her for being bluntly honest.

responding to Commissioner Lopez's legislative update

There is no free lunch and nobody's going to go ahead and build it without having some economic benefit to them.

Acknowledging that builders need financial incentive

I just want to make sure that the language doesn't limit their ability to come back with financing options that might say, okay, you know, we're going to charge X amount for tipping fees.

Seeking clarity on distinction between royalties and tipping fees

I'm against, against, against perpetual royalty. I'm with you a thousand percent.

Strongly opposing lifetime royalty payments

I don't think any of us want to pay a perpetual royalty. I thought that was what we all talked about.

Expressing opposition to perpetual royalty payments

We are going to be given a number of different options, and then we decide. We don't decide today. We may decide then. But those are the options that that's the way I understood it from the workshop and from prior meetings.

Clarifying understanding of decision-making process

If it's given to your staff, it should be given to us, so we can make a good decision.

Directly addressing staff about sharing information with all commissioners

The only thing, Commissioner Gilbert, that the FYFL, which is a good cause, by the way, but there are some teams that are out of Dade County as far as Deerfield Beach. I'm not trying to hurt them, but we just need to find an equitable path forward. Our first and most important goal should always be the residents of Miami-Dade County.

Expressing concern about funding teams outside Miami-Dade County

My high school basketball team, Barry Ivey, may he rest in peace, went to Alabama State, played football.

Personal anecdote related to Alabama State University

I'm going to support the item because I think it's a good thing. My only question, first, Alabama State, I'm fine with.

Supporting Orange Blossom Classic allocation but noting concern about non-county teams

I don't want to see CRAs replace the responsibility of what governments are supposed to do, okay? And there have been many annexations and local governments are supposed to do their job, just like we're supposed to do our job.

Cautioning against CRAs replacing government responsibility

I don't like changing the rules in the middle of the game, like an ACC referee. Whoever's in the pipeline right now should be given due consideration. Let's not change the rules in the middle of the game for the people that have already started the process.

Opposing retroactive application of new CRA standards to pending applications

Let's not give them a reason not to set a standard, because guess what? Even if they don't want us to have a standard, we're going to take the hit. Not somebody else. They're in Tallahassee. We're going to take the hit.

Cautioning about state legislative pressure on CRA standards

We're responsible for it. This body of 13 individuals, and we are responsible for it. Even if the CRA is not in my district, the question I'm going to get is what the heck happened to the standards?

Emphasizing board accountability for CRA oversight

And if we are going to actually dispute that the standard should be transparency and being open, then we've got a problem. Because in anything in life, you can change things if you set a standard.

Advocating for transparency and consistent standards in CRA governance

I'm gonna vote no anyways but because I do want to vote no. But the report we got from our auditor and as I understand it our I don't know if it's a resolution or an ordinance says that we have to choose the person in that district that has lived there the longest.

discussing concerns about appointment process and selection criteria

our I don't know if it's a resolution or an ordinance says that we have to choose the person in that district that has lived there the longest. But there's a problem and I'm not going to say the person's name but it's in your packet. One of those individuals and if you saw the auditor's report has had numerous run-ins with the law and they're pretty substantial.

discussing landscape maintenance district appointment (15C1) and concerns about candidate selection criteria

I've been told that uh well the landscape maintenance district has to have a person who's been the longest resident of the people that are nominated for that or what I put their names in. Well then if that's the case and I got a problem with that I think it should it should require board approval if it requires board approval it shouldn't be just the the person who's been the you know most long-time resident in that district.

Questioning appointment criteria for 15C1 landscape maintenance district

I'm gonna vote no anyways but because I do want to vote no. But the report we got from our auditor and as I understand it our I don't know if it's a resolution or an ordinance says that we have to choose the person in that district that has lived there the longest. But there's a problem and I'm not going to say the person's name but it's in your packet. One of those individuals and if you saw the auditor's report has had numerous run-ins with the law and they're pretty substantial.

Discussion of 15C1 county advisory board appointments with concerns about candidate background

One of my pet peeves is the lack of information being provided to all 13, just selectively. I'm gonna certainly support Commissioner Gilbert's comments. I hope you keep that in mind for all 13 of us, not just me, but to all the others.

Requesting equal information distribution to all commissioners

I'm sensitive to the fact that while I don't represent the folks in North Miami Beach, I'm not trying to hurt them, but we just need to find an equitable path forward.
